1. Acceptance of Terms
These Terms of Service (“Terms”) govern access to and use of the website and services operated by The Art Sutra, a company registered at 11-Parijat Society, Near Nilgiri Everest Society, Diwalipura, Vadodara, Gujarat 390007 (“The Art Sutra,” “we,” “us”). By creating an account or otherwise using the platform, you agree to be bound by these Terms.
2. The Service
The Art Sutra is an online marketplace connecting artists (“Artists”) who list original artwork with buyers (“Collectors”) who purchase it, either at a fixed price or through time-limited offer rounds. The Art Sutra facilitates listings, payment processing, and shipping coordination, but does not itself create, own, or guarantee the authenticity of any artwork listed by Artists.
3. Accounts & Verification
Artists must complete identity verification (KYC) before listing any artwork. Artwork above a value threshold set by The Art Sutra additionally requires a certificate of authenticity or provenance documentation, reviewed by our curatorial team before the listing is published. We reserve the right to reject or remove any listing or account that fails verification or violates these Terms.
4. Listings, Sales & Offers
Artists may list artwork for sale at a fixed price or via a time-limited offer round. Having an offer accepted or completing a fixed-price purchase creates a binding obligation to complete payment. Offer rounds are subject to a minimum-price mechanism: if no qualifying offers are received, the listing may be offered at an estimated fixed price, or reopened to offers at the Artist’s request, subject to an additional fee.
5. Fees & Commission
The Art Sutra charges a commission on each completed sale, and may charge additional fees for premium plan features (including additional listings, priority placement, or promoted ads), as described on our Pricing page. Fees in effect at the time of a transaction apply to that transaction; fee changes will be communicated in advance and do not apply retroactively.
6. Payments
Payments are processed through our third-party payment gateway(s) for standard-value transactions. High-value transactions above a set threshold are settled through a manual, verified bank transfer process coordinated by our operations team. The Art Sutra does not store your full payment card details.
7. Shipping & Delivery
The Art Sutra coordinates insured, tracked shipping for sold artwork through logistics partners. Estimated delivery timelines vary by destination and are communicated at the time of sale. Risk of loss transfers to the Collector upon confirmed delivery, except where covered by our Refund & Cancellation Policy.
8. Intellectual Property
Artists retain all intellectual property rights in their artwork. By listing on The Art Sutra, Artists grant us a limited, non-exclusive license to display images and descriptions of their work for the purpose of operating the marketplace.
9. Authenticity Disclaimer
While high-value listings undergo curatorial review of submitted documentation, The Art Sutra does not independently authenticate every piece and makes no guarantee as to the authenticity, provenance, or value of any artwork beyond the documentation provided by the Artist. Collectors are encouraged to conduct their own due diligence for significant purchases.
10. Limitation of Liability
To the maximum extent permitted by law, The Art Sutra is not liable for indirect, incidental, or consequential damages arising from use of the platform, including disputes between Artists and Collectors regarding the condition, authenticity, or value of artwork.
11. Governing Law
These Terms are governed by the laws of India, and any disputes are subject to the exclusive jurisdiction of the courts of Vadodara, Gujarat.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified to registered users by email or platform notice before taking effect.
